Effective Date: July 28, 2026 By booking with Creekbnb, you acknowledge that you have read, understood, and agree to these Terms & Conditions, including all applicable house rules and property policies. IMPORTANT POLICIES FOR YOUR STAY • Check-in: 4:00 PM or later • Check-out: 11:00 AM • Quiet Hours: 10:00 PM – 8:00 AM • No parties or events • No smoking or vaping inside the property • No pets • Registered overnight guests may not exceed the reservation or property limit • Daytime visitors are limited to the number of registered overnight guests • The primary guest must be at least 25 years old and present throughout the stay • Exterior Ring security cameras monitor entrances and outdoor areas • Street parking only with the provided neighborhood parking permit • One parking permit is provided per reservation • Parking permits must be returned at checkout • A replacement and administrative charge of up to $150 may apply to a lost, damaged, or unreturned parking permit ------------------------------------------------ RESERVATIONS & PAYMENT ------------------------------------------------ A reservation is confirmed only after payment has been successfully processed through Creekbnb’s secure payment processor, Stripe, unless another arrangement has been approved in writing. PAYMENT COLLECTION Payment is collected when the reservation is made unless a different payment schedule has been approved in writing. SECURITY DEPOSIT A security deposit equal to 10% of the booking total or $275, whichever is greater, may be charged or authorized in connection with the reservation. Creekbnb generally initiates release of an unused security-deposit authorization within three days after checkout, subject to inspection of the property and confirmation that there are no damages, missing items, excessive cleaning charges, unpaid fees, or other chargeable conditions. The timing of funds becoming available may depend on the guest’s bank, card issuer, or payment processor. Any deduction or additional charge will be based on documented and reasonably substantiated costs. The security deposit does not limit the guest’s financial responsibility for lawful charges exceeding the deposit amount. ------------------------------------------------ CALIFORNIA 24-HOUR CANCELLATION RIGHT ------------------------------------------------ For a reservation made at least 72 hours before check-in, the guest may cancel without penalty for at least 24 hours after the reservation is confirmed, as required by California law. When a guest properly cancels within this period, all amounts required to be refunded will be returned to the original payment method within the period required by applicable law. After the applicable 24-hour cancellation period has expired, Creekbnb’s stated reservation cancellation policy applies. ------------------------------------------------ RESERVATIONS LONGER THAN 30 DAYS ------------------------------------------------ These Terms & Conditions are intended primarily for transient stays of 30 consecutive days or fewer. Reservations exceeding 30 consecutive days may require a separate written agreement and may be subject to different payment terms, deposits, cancellation provisions, occupancy requirements, and legal rights. Acceptance of a reservation exceeding 30 days does not waive Creekbnb’s right to require an additional written agreement. ------------------------------------------------ CHECK-IN / CHECK-OUT ------------------------------------------------ Check-in: 4:00 PM or later Check-out: 11:00 AM Early check-in and late checkout must be approved in advance. Approval is not guaranteed and depends on the reservation calendar and housekeeping schedule. An approved early check-in or late checkout may be subject to an additional fee disclosed in advance. Guests are encouraged to send Creekbnb a brief message after they have fully checked out. This helps coordinate housekeeping and prepare the property for the next reservation. Remaining in the property beyond the approved checkout time without authorization may result in additional charges and any other remedies permitted by law. ------------------------------------------------ HOUSE RULES ------------------------------------------------ Guests agree to follow all house rules and reasonable property instructions throughout their stay. REGISTERED OVERNIGHT OCCUPANCY The maximum number of registered overnight guests is stated in the applicable property listing and reservation. Current maximum registered overnight occupancy: • The Walnut: 3 guests • The Creek: 4 guests • The Acorn: 4 guests • The Shuey: 4 guests • The Almond: 4 guests Unregistered overnight guests are not permitted. DAYTIME VISITORS Guests may have daytime visitors equal to the number of registered overnight guests included on the reservation. Examples: • 1 registered overnight guest may have up to 1 daytime visitor • 2 registered overnight guests may have up to 2 daytime visitors • 3 registered overnight guests may have up to 3 daytime visitors • 4 registered overnight guests may have up to 4 daytime visitors Daytime visitors may not remain overnight unless they are added to the reservation in advance and the property’s maximum registered overnight occupancy is not exceeded. The primary guest is responsible for the conduct of every registered guest and visitor. Parties, events, unauthorized gatherings, and disruptive activity are prohibited regardless of the number of people present. QUIET HOURS Quiet hours are from 10:00 PM to 8:00 AM. Guests must maintain reasonable noise levels at all times and avoid disturbing neighbors. PARTIES & EVENTS Parties, receptions, events, commercial activities, and unauthorized gatherings are not permitted. SMOKING & VAPING Smoking and vaping are strictly prohibited inside the property. Guests may be responsible for reasonable costs resulting from smoking or vaping, including additional cleaning, odor remediation, damaged furnishings, and documented loss of use. PETS Pets are not permitted unless Creekbnb has expressly approved an exception in writing or applicable law requires an accommodation. ------------------------------------------------ PARKING ------------------------------------------------ All active Creekbnb properties require street parking with the provided neighborhood parking permit. Each reservation includes: • One neighborhood parking permit • Parking authorization for one guest vehicle Additional Creekbnb parking permits are not available. The parking permit must be displayed as instructed and returned at checkout. Vehicles without a properly displayed permit may be ticketed or otherwise subject to local parking enforcement. Guests must not block sidewalks, driveways, neighboring properties, vehicle access, or pedestrian access. A reasonable replacement and administrative charge of up to $150 may apply when a permit is lost, damaged, or not returned. The charge reflects reasonable replacement, administrative, and operational costs and will not exceed the amount permitted by applicable law. ------------------------------------------------ NOISE & DISTURBANCE POLICY ------------------------------------------------ Creekbnb properties are located in residential neighborhoods. Guests are expected to respect neighbors and maintain reasonable noise levels at all times. Excessive noise, parties, disturbances, or complaints from neighbors, law enforcement, or local authorities may result in: • A warning • Removal of unauthorized guests or visitors • Reasonable additional charges resulting from the violation • Termination of the stay for a material or repeated violation Guests are responsible for the conduct of all registered guests and visitors. ------------------------------------------------ GUEST RESPONSIBILITY FOR PROPERTY & DAMAGES ------------------------------------------------ Guests agree to use the property, furnishings, appliances, and amenities responsibly and to leave them in substantially the same condition in which they were received, ordinary wear and tear excepted. Guests must promptly report damage, malfunction, unsafe conditions, missing items, water leaks, electrical concerns, or other significant problems. Guests may be responsible for reasonably documented costs caused by the acts or omissions of the guest, registered occupants, or visitors, including: • Property damage • Missing or damaged items • Lost, damaged, or unreturned parking permits • Cleaning beyond normal turnover • Stained or damaged linens, towels, furnishings, or surfaces • Unauthorized guests or gatherings • House-rule violations • Fines or other costs caused by the guest’s conduct • Other losses directly resulting from the reservation By completing the reservation, the guest authorizes Creekbnb to submit lawful and reasonably substantiated charges through the payment method or payment processor associated with the reservation, subject to applicable payment-processing requirements. The security deposit does not limit the guest’s responsibility for lawful charges exceeding the deposit amount. ------------------------------------------------ EXTRA CLEANING & CONDITION OF PROPERTY ------------------------------------------------ Guests are expected to leave the property in a reasonably clean and orderly condition. The standard cleaning fee covers routine turnover cleaning. Additional cleaning charges may apply when extra labor, professional cleaning, repair, replacement, or remediation is reasonably required due to conditions beyond normal use, including: • Excessive mess • Spills or stains • Smoking or vaping • Strong odors • Glitter or confetti • Decorations or adhesive residue • Bodily fluids • Excessive garbage • Misuse of furnishings or appliances • Permanently stained or damaged linens or towels • Other unusual conditions requiring extended cleaning Any additional charge will be based on reasonably documented costs. ------------------------------------------------ CHECKOUT RESPONSIBILITIES ------------------------------------------------ Before leaving, guests are asked to: • Check out by 11:00 AM • Return the parking permit • Place used towels in the designated tub or shower • Remove garbage and place it in the designated outdoor bin • Take all personal belongings • Close the entry door • Touch the keypad to illuminate it • Press the Lock button to engage the deadbolt Guests are encouraged to send Creekbnb a brief message after departure so housekeeping can be coordinated promptly. ------------------------------------------------ LOST & FOUND POLICY ------------------------------------------------ Creekbnb is not responsible for personal property left behind after checkout. When an item is found, Creekbnb will make reasonable efforts to notify the guest using the contact information associated with the reservation. Found items will generally be held for 14 days after checkout. Guests requesting return of an item are responsible for packaging, shipping, insurance, and related costs. Items not claimed within 14 days may be discarded or donated. Creekbnb does not guarantee recovery of any item left behind. ------------------------------------------------ ACCESS TO PROPERTY ------------------------------------------------ The guest agrees to allow Creekbnb, the property owner, or authorized representatives reasonable access to the property when necessary for: • Maintenance • Repairs • Inspections • Housekeeping • Contractor access • Safety concerns • Protection of guests, neighbors, or the property Authorized representatives may include cleaners, maintenance personnel, contractors, property managers, owners, and emergency personnel. Whenever reasonably possible, notice will be provided before entry. In an emergency, or when immediate action is reasonably necessary to protect people or property, Creekbnb or its authorized representatives may enter without prior notice if the guest cannot be reached promptly. ------------------------------------------------ RIGHT TO REFUSE SERVICE / TERMINATE STAY ------------------------------------------------ Creekbnb may refuse service, cancel a reservation, or terminate a stay for a material or repeated violation of these Terms & Conditions, subject to applicable law. Grounds may include: • Exceeding permitted occupancy • Having unauthorized overnight guests • Exceeding permitted daytime visitor limits • Hosting a party, event, or unauthorized gathering • Excessive noise or neighborhood disturbances • Illegal activity • Intentional or serious property damage • Threatening or abusive conduct • Interference with security or safety equipment • Refusal to comply with reasonable safety or house-rule instructions When a stay is lawfully terminated, guests must vacate upon request. Refund eligibility, if any, will depend on the circumstances, amounts already earned, resulting costs or damages, applicable cancellation terms, and applicable law. Guests remain responsible for lawful and reasonably documented charges resulting from their conduct. ------------------------------------------------ SECURITY CAMERAS & EXTERIOR MONITORING ------------------------------------------------ For the safety and security of guests, neighbors, and the property, Creekbnb properties are equipped with disclosed exterior Ring security cameras. Cameras may monitor outdoor areas such as: • Entrances • Walkways • Parking areas • Driveways • Exterior common areas The cameras are outward-facing and do not monitor interior rooms or private indoor guest areas. Camera footage may be reviewed in connection with safety concerns, property incidents, suspected occupancy violations, unauthorized gatherings, parking issues, or other suspected house-rule violations. Guests must not cover, disable, disconnect, reposition, damage, or interfere with security cameras or related equipment. ------------------------------------------------ OCCUPANCY VERIFICATION ------------------------------------------------ Exterior security cameras and other reasonable, lawful methods may be used to investigate suspected occupancy, visitor, parking, safety, or house-rule violations. Unauthorized overnight guests, excessive visitors, or prohibited gatherings may result in removal of unauthorized individuals, reasonable additional charges, or termination of the reservation for a material or repeated violation. ------------------------------------------------ ID VERIFICATION & BOOKING ELIGIBILITY ------------------------------------------------ The person making the reservation must: • Be at least 25 years old • Be the responsible primary guest • Be present throughout the stay • Provide accurate reservation and contact information The primary guest may be required to provide valid government-issued identification. Reservations made on behalf of another person, including unauthorized third-party bookings, are not permitted without prior written approval. ------------------------------------------------ MAIL & PACKAGE POLICY ------------------------------------------------ Guests may not use the property address to: • Receive mail or packages • Establish a mailing address • Register a business • Obtain identification • Establish residency or tenancy Creekbnb is not responsible for mail or packages delivered to a property. Use of a property address does not establish residency, tenancy, or a right to occupy the property beyond the confirmed reservation period. ------------------------------------------------ INTERNET & TELEVISION SERVICE ------------------------------------------------ Internet and television access are provided as guest conveniences and are not guaranteed to be uninterrupted. Creekbnb is not responsible for service interruptions caused by internet providers, utility providers, equipment failures, severe weather, power outages, or other circumstances outside Creekbnb’s reasonable control. Guests should contact Creekbnb if they experience an ongoing internet or television problem. Guests must not tamper with, damage, remove, or interfere with networking, television, or related equipment. ------------------------------------------------ PAYMENT DISPUTES & CHARGEBACKS ------------------------------------------------ Guests agree to contact Creekbnb directly and make a good-faith effort to resolve billing questions before initiating a payment dispute or chargeback. Creekbnb may provide relevant documentation to payment processors or financial institutions in response to a dispute, including: • These Terms & Conditions • Reservation records • Payment records • Photographs • Invoices • Guest communications • Access records • Housekeeping or maintenance documentation • Other relevant records Nothing in this provision waives any consumer right that cannot lawfully be waived. ------------------------------------------------ LIMITATION OF LIABILITY ------------------------------------------------ Guests use the property, furnishings, appliances, exterior areas, and amenities at their own risk and are responsible for exercising reasonable care. To the fullest extent permitted by law, Creekbnb, the property owner, and their authorized representatives are not responsible for loss, injury, illness, theft, property damage, or service interruption caused by: • Risks inherent in ordinary use of the property • The acts or omissions of the guest, registered occupants, or visitors • Third parties • Utility or service-provider outages • Weather or other circumstances outside their reasonable control Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, gross negligence, or violation of law. Guests are responsible for supervising children and visitors and for using the property safely. ------------------------------------------------ INDEMNIFICATION ------------------------------------------------ To the fullest extent permitted by law, guests agree to indemnify and hold harmless Creekbnb, the property owner, and their authorized representatives from third-party claims, losses, damages, costs, or expenses arising from: • The acts or omissions of the guest • The conduct of registered occupants or visitors • The guest’s negligence or misconduct • Violation of these Terms & Conditions • Illegal or prohibited activity • Misuse of the property This obligation does not apply to the extent a claim or loss was caused by Creekbnb’s or the property owner’s negligence, willful misconduct, or violation of law. ------------------------------------------------ FORCE MAJEURE ------------------------------------------------ Creekbnb is not responsible for delays, interruptions, cancellations, or conditions caused by circumstances outside its reasonable control, including: • Natural disasters • Severe weather • Wildfires or smoke conditions • Power, water, internet, or utility outages • Government orders or restrictions • Public emergencies • Transportation disruptions • Labor disruptions • Other force-majeure events Any refund or cancellation rights will be determined by the reservation’s cancellation policy and applicable law. ------------------------------------------------ PRIVACY & DATA USE ------------------------------------------------ Creekbnb may collect information reasonably necessary to manage reservations and communicate with guests, including: • Name • Phone number • Email address • Reservation details • Guest communications • Identification information when required • Payment information processed through Stripe or another authorized processor Information may be used for legitimate business purposes, including: • Processing and managing reservations • Communicating with guests • Providing property access • Coordinating housekeeping and maintenance • Responding to safety concerns or emergencies • Enforcing house rules • Processing authorized charges • Preventing fraud • Responding to disputes • Complying with legal obligations Creekbnb does not sell guest personal information. Information may be shared with property owners, authorized staff, contractors, service providers, payment processors, emergency personnel, or government authorities when reasonably necessary for these purposes. Guests may contact Creekbnb regarding their personal information. Creekbnb will honor applicable privacy rights as required by California law. ------------------------------------------------ GOVERNING LAW & VENUE ------------------------------------------------ These Terms & Conditions are governed by the laws of the State of California. Any legal proceeding arising from the reservation or stay will be brought in an appropriate court located in Contra Costa County, California, unless applicable law requires another venue. ------------------------------------------------ SEVERABILITY ------------------------------------------------ If any provision of these Terms & Conditions is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permitted, and the remaining provisions will continue in effect. ------------------------------------------------ NO WAIVER ------------------------------------------------ Creekbnb’s failure to enforce a provision on one occasion does not waive its right to enforce that provision or another provision on a later occasion. ------------------------------------------------ ENTIRE AGREEMENT ------------------------------------------------ These Terms & Conditions, the reservation confirmation, the applicable property listing, and written instructions approved by Creekbnb constitute the agreement governing the reservation. Property-specific instructions and written communications provided for a reservation may supplement these Terms & Conditions. When a property-specific written instruction directly conflicts with a general provision, the more specific current written instruction will control to the extent permitted by law. ------------------------------------------------ AGREEMENT ------------------------------------------------ By completing a reservation with Creekbnb, the guest acknowledges that they have read, understood, and agreed to these Terms & Conditions and all applicable house rules and policies.
